Welcome to Fish Fish! These Terms of Service govern your use of our fly fishing companion app. By accessing or using Fish Fish, you agree to be bound by these terms. Please read them carefully.

1. Acceptance of Terms

By creating an account or using Fish Fish, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our service.

Age Requirement: You must be at least 18 years old to use Fish Fish. By using our service, you represent and warrant that you are at least 18 years of age.
Legal Capacity: You must have the legal capacity to enter into a binding agreement.
Account Responsibility: You are responsible for maintaining the confidentiality of your account and for all activities under your account.

2. Acceptable Use

You agree to use Fish Fish only for lawful purposes and in accordance with these terms. You agree not to:

Illegal Activities: Use the service for any illegal purpose or in violation of any local, state, national, or international law.
Harassment: Harass, abuse, or harm another person, or engage in any conduct that is threatening, intimidating, or discriminatory.
False Information: Submit false, misleading, or inaccurate information, including fake catch records or fabricated fishing data.
Unauthorized Access: Attempt to gain unauthorized access to other users' accounts, our systems, or any protected areas of the service.
Interference: Interfere with or disrupt the service, servers, or networks connected to the service.
Automated Access: Use bots, scrapers, or other automated means to access the service without our express written permission.

3. Account Responsibilities

When you create an account with Fish Fish, you agree to the following:

Accurate Information: Provide accurate, current, and complete information during registration and keep your profile information up to date.
Secure Credentials: Keep your login credentials secure and confidential. Do not share your password with others.
Notification of Breach: Notify us immediately if you suspect any unauthorized access to or use of your account.
Account Activity: You are responsible for all activity that occurs under your account, whether or not you authorized it.
One Account Per Person: Each person may only maintain one account. Creating multiple accounts may result in termination.

4. Intellectual Property

The ownership of content and materials on Fish Fish is as follows:

Our Property: The Fish Fish app, including its design, features, functionality, logos, and all associated intellectual property, is owned by Fish Fish and protected by copyright, trademark, and other laws.
Your Content: You retain ownership of all catch data, photos, notes, and other content you create and upload to Fish Fish.
License to Us: By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely for the purpose of providing and improving the service.
No Unauthorized Use: You may not copy, modify, distribute, or reverse engineer any part of Fish Fish without our express written consent.

5. Limitation of Liability

Please be aware of the following limitations:

Service "As Is": Fish Fish is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
No Guarantee: We do not guarantee that the service will be uninterrupted, secure, or error-free.
Data Loss: We are not responsible for any loss of data, including catch records, photos, or other content. We recommend you maintain backups of important data.
Third-Party Services: We are not liable for the actions, content, or data of third-party services integrated with Fish Fish.
Maximum Liability: To the maximum extent permitted by law, our total liability to you for any claims arising from your use of the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

6. Termination

Either party may terminate this agreement under the following conditions:

User Termination: You may delete your account at any time through your profile settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.
Our Termination Rights: We may suspend or terminate your account immediately, without prior notice, if you violate these Terms of Service.
Effect of Termination: Upon termination, your right to use the service will immediately cease. Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, and limitations of liability.
Data After Termination: After account deletion, we may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

7. Governing Law

These terms are governed by the following legal framework:

Jurisdiction: These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Dispute Resolution: Any disputes arising from these terms or your use of Fish Fish shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
Class Action Waiver: You agree to resolve any disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
Venue: Any legal proceedings that cannot be resolved through arbitration shall be brought in the state or federal courts located in Delaware.
